This website is operated by The Springs LLC DBA Cold Spring (“Cold Spring”, “we”, “us”, or “our”). Throughout the site, the terms “we”, “us” and “our” refer to Cold Spring. Cold Spring offers this website, including all information, tools, products, and services available from this site, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site, purchasing from us, or using our services, you engage in our “Service” and agree to be bound by the following Terms of Service (“Terms”), including any additional policies referenced herein, including our Refund Policy, Shipping Policy, and Privacy Policy.

SECTION 2 - PRODUCTS & CUSTOM STRUCTURES
Cold Spring designs, sells, and delivers custom-built outdoor structures, saunas, wellness spaces, and related products throughout the Continental United States.
All structures are custom built to order. Due to the customized nature of our products, variations in wood grain, texture, knots, checking, color tone, shrinkage, expansion, weathering, and other naturally occurring material characteristics are expected and are not considered defects.
Renderings, photography, mockups, and visualizations are for illustrative purposes only and may not perfectly represent final delivered products.
We reserve the right to modify product specifications, materials, suppliers, dimensions, features, or components without notice when reasonably necessary for manufacturing, engineering, safety, supply chain, or operational purposes.
SECTION 3 - ORDERS & PAYMENTS
Submission of an order does not guarantee acceptance. Cold Spring reserves the right to accept or reject any order at our sole discretion.
Customers are responsible for reviewing all order details, specifications, dimensions, site access requirements, and customization selections prior to production approval.
Payments, deposits, cancellation terms, and refund eligibility are governed by our Refund Policy.
SECTION 4 - SHIPPING, DELIVERY & SITE ACCESS
Delivery timelines are estimates only and are not guaranteed.
Customers are solely responsible for ensuring adequate site access, clearance, permitting, foundation preparation, utility readiness, and delivery conditions prior to shipment and delivery.
Cold Spring shall not be responsible for additional costs associated with failed delivery attempts, inaccessible sites, crane requirements, storage fees, rescheduled deliveries, or customer site conditions.
Risk of loss transfers to the customer upon delivery.
Customers must inspect all products immediately upon delivery and report any shipping-related damage promptly. Failure to report visible shipping damage within a reasonable timeframe may impact claim eligibility.
SECTION 5 - LIMITED WARRANTY
Residential Structural Warranty
Cold Spring provides the original residential purchaser with a limited five (5) year warranty covering defects in structural workmanship and factory manufacturing under normal residential use beginning on the date of delivery.
This warranty is limited solely to repair, replacement parts, or replacement of defective components, as determined by Cold Spring in its sole discretion.
Cold Spring may, at its discretion, provide or subsidize reasonable field service for verified manufacturing defects. Service coverage may vary based on geographic location and service accessibility. Certain remote or high-cost service areas may require customer participation in labor, travel, transportation, or related service expenses.
This warranty applies only to the original purchaser and is non-transferable.
Commercial Warranty
Structures used for commercial purposes are covered by a limited two (2) year structural workmanship warranty.
Commercial use includes, but is not limited to:

Short-term rentals

Airbnb or vacation rentals
-
Hospitality properties
-
Gyms
-
Wellness studios
-
Spas
-
Shared-use facilities
-
Community or multi-user environments
-
Any non-single-family residential use
Commercial environments may place substantially greater wear on structures and components, resulting in reduced warranty coverage.
Third-Party Equipment Warranty
Sauna heaters, infrared systems, controls, heat pumps, mini split systems, chillers, lighting systems, speakers, electronics, and other third-party manufactured equipment are not covered under Cold Spring’s structural warranty.
Such products are subject solely to the individual manufacturer’s warranty terms and coverage guidelines.
Warranty coverage, duration, and remedies vary by manufacturer. Labor, diagnosis, field service, travel expenses, and replacement installation costs for third-party equipment are generally not included unless expressly stated by the applicable manufacturer.
Customers may contact Cold Spring for assistance coordinating manufacturer claims or obtaining manufacturer warranty information.
SECTION 6 - WARRANTY EXCLUSIONS
This warranty does not cover:

Normal wear and tear

Cosmetic aging or weathering

Natural wood movement, checking, knots, shrinkage, expansion, or discoloration

Surface corrosion or finish deterioration

Moisture-related expansion or contraction
-
Minor cracking or cosmetic imperfections

Damage caused by misuse, abuse, neglect, or improper maintenance

Improper electrical, plumbing, HVAC, drainage, or site installation
-
Failure to comply with local codes, ordinances, or permitting requirements

Improper ventilation or excessive moisture conditions
-
Water intrusion caused by customer negligence
-
Flooding or standing water
-
Snow or ice accumulation
-
Leaving doors, windows, or accordion systems open during weather events
-
Mold, mildew, condensation, rot, or moisture-related damage
-
Fire damage
-
Damage caused by unauthorized modifications or repairs
-
Damage caused by transportation after delivery
-
Damage caused by foundation settling, shifting, or improper site preparation
-
Damage resulting from commercial overuse
-
Acts of God, including storms, flooding, hurricanes, earthquakes, lightning, or severe weather

Damage caused by chemicals, salt exposure, or environmental contaminants
Cold Spring reserves the right to inspect, photograph, evaluate, or request documentation regarding any warranty claim prior to approval.
SECTION 7 - CUSTOMER RESPONSIBILITIES
Customers are solely responsible for:

Hiring properly licensed contractors where required

Electrical connections and code compliance

Plumbing, drainage, and utility installation

Site preparation and foundation work
-
Permit acquisition and zoning compliance unless otherwise agreed in writing

Ongoing maintenance and weather protection

Snow and ice management
-
Proper operation and ventilation of the structure and equipment
Failure to properly maintain the structure may void warranty coverage.
SECTION 8 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, Cold Spring shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the purchase, installation, delivery, operation, or use of any product or service.
This includes, but is not limited to:

Property damage

Water damage
-
Fire damage
-
Loss of use
-
Business interruption
-
Lost profits
-
Temporary housing
-
Mold remediation
-
Electrical failures
-
Code violations
-
Contractor costs
-
Removal or reinstallation expenses
Cold Spring’s total liability for any claim shall not exceed the original purchase price of the product.
SECTION 9 - DISCLAIMER OF WARRANTIES
Except as expressly stated herein, all products and services are provided “as is” and “as available” without warranties of any kind, either express or implied, including implied warranties of merchantability or fitness for a particular purpose.
No dealer, installer, contractor, salesperson, or representative is authorized to modify or extend any warranty unless confirmed in writing by Cold Spring.
SECTION 10 - GOVERNING LAW
These Terms shall be governed by and interpreted under the laws of the State of Delaware.
Any disputes arising from these Terms or the purchase or use of Cold Spring products shall be subject to the exclusive jurisdiction of the courts located in the State of Delaware.
SECTION 11 - CHANGES TO TERMS
Cold Spring reserves the right to update or modify these Terms at any time without prior notice. Continued use of the website or services following any changes constitutes acceptance of those changes.
